《邯鄲市人民政府關(guān)于修改和廢止部分政府規(guī)章的決定》已經(jīng)2013年1月11日邯鄲市人民政府第69次常務(wù)會議審議通過，現(xiàn)予公布，自2013年2月1日起施行。

     The Decision of Handan Municipal People's Government on Amending and Repealing Some Government Rules was adopted upon deliberation at the 69^th executive meeting of Handan Municipal People’s Government on January 11, 2013, are hereby promulgated, and shall go into effect as of February 1, 2013.

邯鄲市人民政府關(guān)于修改和廢止部分政府規(guī)章的決定

（2013年1月16日邯鄲市人民政府令第141號發(fā)布）

Decision of Handan Municipal People's Government on Amending and Repealing Some Government Rules

（Promulgated by Decree No.141 of the Handan Municipal People's Government on January 16, 2013）

為維護(hù)社會主義法制統(tǒng)一，全面推進(jìn)依法行政，市政府對現(xiàn)行政府規(guī)章進(jìn)行了清理。

經(jīng)過清理，市政府決定：

In order to maintain the consistency of the socialist legal system, and comprehensively promoting the “administration by law,” Handan Municipal People's Government has reviewed all the existing local government rules. Upon review, the local government decides that:

一、修改4件政府規(guī)章的部分條款

I. Certain articles of the four rules shall be amended.

（一）刪去《邯鄲市營業(yè)性演出管理暫行規(guī)定》第八條和第十五條第（六）、（七）、（九）項(xiàng)。

（I）Article 8 and the Items (6), (7) & (9) of Article 15 of the Interim Provisions of Handan Municipality on the Administration of Commercial Performance are deleted.

     （二）將《邯鄲市城市排水管理辦法》第三十九條修改為：“未按規(guī)定繳納污水處理費(fèi)，責(zé)令限期繳納。逾期不繳納的，中止其使用城市排水設(shè)施?！?/span>

（II）Article 39 of the Measures of Handan Municipality on the Administration of Urban Drainage is amended to read: “If failing to pay, as provided for by the Stipulation, the fee for pollutant discharge, it shall be ordered to pay up within a time limit; and after the expiration of the specified time, it is forbidden to use the urban drainage facilities.”

（三）刪去《邯鄲市公路旅客運(yùn)輸管理辦法》第29條和第35第（七）、（八）項(xiàng)，將第35條第（二）項(xiàng)修改為：“不按站（點(diǎn)）發(fā)車或核定路線行駛的，責(zé)令改正，可并處1000元以下罰款”。

（III）Article 29 and the Items (7) & (9) of Article 35 of the Measures of Handan Municipality on the Administration of Road Passengers Transport are deleted; and the Item (2) of Article 35 is amended to read: “If failing to start from the approved passenger station, or failing to comply with the approved route, it shall be ordered to correct, and a fine of 1,000 Chinese Renminbi Yuan shall be imposed concurrently.”

    （四）將《邯鄲市殯葬管理實(shí)施辦法》第33條修改為“違反本辦法第八條規(guī)定私自土葬的，由民政部門責(zé)令限期改正”。

(IV) Article 33 of the Measures of Handan Municipality on the Implementation for Funeral and Interment Control is amended to read: “Where the remains are buried in the ground without permission in violation of the provisions of Article 8, the department of civil affairs shall order the violator to make corrections within a prescribed time limit.

二、廢止3件政府規(guī)章

II. The three rules shall be repealed.

（一）《邯鄲市城市規(guī)劃管理?xiàng)l例實(shí)施細(xì)則》（2001年2月27日邯鄲市人民政府第62次常務(wù)會議通過，2001年3月27日邯鄲市人民政府第89號令公布）。

（I）The Detailed Implementation Rules to the Regulations of Handan Municipality on the Administration of Urban Planning (Adopted at the 62^nd executive meeting of Handan Municipal People’s Government on February 27, 2001. Promulgated by Decree No.89 of the Handan Municipal People's Government on March 27, 2001)

（二）《邯鄲市城市房屋拆遷管理辦法》（2003年2月11日邯鄲市人民政府第92次常務(wù)會議通過，2003年2月18日邯鄲市人民政府第95號令公布）。

（II）The Measures of Handan Municipality on the  Administration of the Dismantlement of Urban Houses (Adopted at the 92^nd executive meeting of Handan Municipal People’s Government on February 11, 2003. Promulgated by Decree No.95 of the Handan Municipal People's Government on February 18, 2003)

（三）《邯鄲市滏陽河污染綜合防治暫行辦法》（2000年8月18日邯鄲市人民政府第52次常務(wù)會議通過  2000年9月5日邯鄲市人民政府第83令號公布  2010年12月20日邯鄲市人民政府第135號令修正）。

（III）The Interim Measures of Handan Municipality on the Administration of the Integrated Pollution Prevention (Adopted at the 52^nd executive meeting of Handan Municipal People’s Government on August 18, 2000. Promulgated by Decree No.83 of the Handan Municipal People's Government on September 5, 2000. Amended and re-promulgated by Decree No.135 of the Handan Municipal People's Government on December 20, 2010 )
