《邯鄲市消火栓管理辦法》已經(jīng)

The Measures of Handan Municipality on the Administration of Fire Hydrants which was adopted on the 60th executive meeting of Handan Municipal People’s Government of December 15, 2016, is hereby promulgated and shall come into force on February 1, 2017.

Measures of
第一條 為了加強(qiáng)消火栓管理，確保消防用水，保護(hù)人身和財(cái)產(chǎn)安全，根據(jù)《中華人民共和國(guó)消防法》、《河北省消防條例》和有關(guān)法律法規(guī)，結(jié)合本市實(shí)際，制定本辦法。
Article 1 The Measures are formulated in accordance with the Fire Control Law of the People's Republic of China, the Regulations of Hebei Province on Fire Control and the relevant laws and regulations in light of the specific situation of this municipality, and for the purpose of strengthening the administration of fire control, ensuring the safety in the water-supply of the fire-fighting and safeguarding the personal and property security.
第二條 本市行政區(qū)域內(nèi)消火栓的規(guī)劃、建設(shè)、使用、維護(hù)以及監(jiān)督管理活動(dòng)，適用本辦法。
Article 2 These Measures shall apply to planning, construction, use, maintenance and the supervision of the fire hydrants within
第三條 本辦法所稱消火栓，是指與供水管網(wǎng)連接，由閥門、出水口和殼體等組成的專門用于滅火救援的消防供水裝置及其附屬設(shè)施，包括城市道路配建的消火栓（以下簡(jiǎn)稱“市政消火栓”，含消防水鶴）、單位配建的消火栓（以下簡(jiǎn)稱“單位消火栓”）、居民住宅區(qū)配建的消火栓（以下簡(jiǎn)稱“居民消火栓”）。
Article 3 The fire hydrant mentioned in these Measures refers to fire water supply equipment and ancillary facilities that are connected with the water supply network, composed of a valve, a water outlet and a shell etc., and are designed specifically for firefighting and fire rescue. The fire hydrants built with the urban roads (hereinafter referred to as "the municipal fire hydrant", including the fire water crane), the fire hydrants built with enterprise and public institutions (hereinafter referred to as "the institutional fire hydrant”) and the fire hydrants built with residential areas (hereinafter referred to as "the residential fire hydrant”) are included.
第四條 市、縣（市、區(qū)）公安機(jī)關(guān)對(duì)本行政區(qū)域內(nèi)的消火栓實(shí)施監(jiān)督管理，并由本級(jí)公安機(jī)關(guān)消防機(jī)構(gòu)負(fù)責(zé)具體實(shí)施。
建設(shè)、城市供水管理、規(guī)劃、國(guó)土資源、財(cái)政、質(zhì)監(jiān)等部門應(yīng)當(dāng)在各自職責(zé)范圍內(nèi)做好消火栓管理的相關(guān)工作。
Article 4
Those departments in charge of urban-rural development, city water supply, urban planning, territorial resources, finance, quality supervision should ensure good management within the scope of their respective duties.
第五條 市政消火栓的新建、改建、補(bǔ)建、維護(hù)保養(yǎng)經(jīng)費(fèi)應(yīng)當(dāng)列入政府財(cái)政預(yù)算，按年度撥付供水企業(yè)。市、縣（市、區(qū)）財(cái)政應(yīng)當(dāng)加大對(duì)市政消火栓補(bǔ)建資金投入。
單位消火栓的建設(shè)經(jīng)費(fèi)和維護(hù)保養(yǎng)經(jīng)費(fèi)由單位承擔(dān)。
Article 5 For sustainable management to ensure and good maintenance the government should include in the budget the expenses of new construction, reconstruction, supplemental construction and maintenance of fire hydrant, which will be allocated to the water supply enterprises annually. The Municipality and counties (the city and the districts) finance should increase their investment to build up municipal fire hydrant.
The construction and maintenance expenses of institutional fire hydrant will be sponsored by the enterprise and public institutions.
居民消火栓的建設(shè)經(jīng)費(fèi)和保修期內(nèi)的維修保養(yǎng)經(jīng)費(fèi)由建設(shè)單位承擔(dān)，保修期滿后的維修保養(yǎng)經(jīng)費(fèi)納入住宅專項(xiàng)維修資金。
The construction and maintenance expenses of residential fire hydrant will be sponsored by the construction unit. After the expiration of the warranty period, the maintenance expenses will be included into the special maintenance funds.
第六條 公安機(jī)關(guān)會(huì)同規(guī)劃部門編制消防規(guī)劃時(shí)，應(yīng)當(dāng)包括消火栓布局規(guī)劃。城市道路主管部門、城市供水主管部門、規(guī)劃部門在編制城市道路規(guī)劃和供水專項(xiàng)規(guī)劃時(shí)，對(duì)涉及市政消火栓設(shè)置的內(nèi)容應(yīng)當(dāng)征詢本級(jí)公安機(jī)關(guān)消防機(jī)構(gòu)的意見。
Article 6 The location planning of the fire hydrant should be included in the fire control planning, which is made by the public security organization and the planning department. The competent department of urban roads, urban water supply and urban planning should consult the fire control institutions of the corresponding public security organs respecting the setting of municipal fire hydrant, when designing and planning the urban road and water supply.
第七條 消火栓應(yīng)當(dāng)與城市道路、單位建筑、居民住宅等建設(shè)工程同步設(shè)計(jì)、同步建設(shè)、同步投入使用。建設(shè)單位在組織進(jìn)行消火栓及其供水管線的設(shè)計(jì)、施工時(shí)，應(yīng)當(dāng)符合國(guó)家工程建設(shè)消防技術(shù)標(biāo)準(zhǔn)，保證消火栓的數(shù)量、布點(diǎn)等符合相關(guān)規(guī)劃要求。
消火栓的質(zhì)量應(yīng)當(dāng)符合國(guó)家標(biāo)準(zhǔn)或者行業(yè)標(biāo)準(zhǔn)以及強(qiáng)制性產(chǎn)品認(rèn)證要求。
Article 7 The design, construction and the use of fire hydrants should be work in collaboration with other construction projects such as urban roads, institutional construction and residential buildings. The design and construction of the fire hydrants and its water supply tube carried by the construction unit should be in accordance with National technical standards for fire control of engineering construction, so that the fire hydrants quantity and layout etc can meet the relevant requirements.
The quality of the fire hydrants shall meet the national standards or industry standards and mandatory product certification requirements.
第八條 城市道路建設(shè)單位會(huì)同供水企業(yè)組織市政消火栓的新建、補(bǔ)建、遷建、拆除等建設(shè)工作，由供水企業(yè)具體負(fù)責(zé)實(shí)施。
單位消火栓和居民消火栓由建設(shè)單位負(fù)責(zé)按照相關(guān)標(biāo)準(zhǔn)建設(shè)。
Article 8 The urban road construction unit and the water supply enterprise will ensure the construction work of the fire hydrants like the new construction, supplementary construction, relocation, and the demolition work. The water supply enterprise is responsible for the concrete implementation.
The construction unit is responsible for the construction of Institutional and residential fire hydrants, which has to be in conformity with relevant standards.
第九條 現(xiàn)有市政消火栓數(shù)量不足或不適應(yīng)實(shí)際需要的，應(yīng)當(dāng)予以補(bǔ)建；城市道路或者供水管網(wǎng)改造時(shí)，必須同步建設(shè)市政消火栓。
現(xiàn)有建筑未按規(guī)定配套建設(shè)消火栓的，產(chǎn)權(quán)人或者其他責(zé)任單位應(yīng)當(dāng)逐步配套建設(shè)。
Article 9 There should be a supplementary construction when the current municipal fire hydrants are not enough or do not cater to the actual needs. When there is a reconstruction of urban road or the water supply network, the municipal fire hydrants should be updated simultaneously.
If the existing building failed to install fire hydrants in accordance with the provisions, the owner of the property or other responsible institutions should install fire hydrants later on.
第十條 城市道路驗(yàn)收后，供水企業(yè)應(yīng)當(dāng)將市政消火栓設(shè)置地點(diǎn)、數(shù)量、規(guī)格、分布等情況書面告知公安機(jī)關(guān)消防機(jī)構(gòu)。
單位消火栓和居民消火栓所在建設(shè)工程依法應(yīng)當(dāng)進(jìn)行消防驗(yàn)收或者消防竣工備案的，建設(shè)工程竣工后，建設(shè)單位應(yīng)當(dāng)向公安機(jī)關(guān)消防機(jī)構(gòu)申請(qǐng)消防驗(yàn)收或者備案。
Article 10 The water supply enterprise should report the basic information of the municipal fire hydrants setting in writing to the fire control institutions of the corresponding public security organs after the urban roads are inspected and accepted, which may include their location, quantity, specifications and layout.
As for the institutional and residential fire hydrants, the construction unit should apply to the fire control inspection or the filing to them after the completion of the construction project.
第十一條 消火栓不得用于與消防和應(yīng)急救援無(wú)關(guān)的事項(xiàng)。因園林綠化、市容環(huán)衛(wèi)等公共事業(yè)確需臨時(shí)使用市政消火栓的，使用單位應(yīng)當(dāng)與供水企業(yè)簽訂用水協(xié)議，在規(guī)定的時(shí)間、地點(diǎn)使用。
Article 11 The fire hydrants are not allowed to be applied to, for matters irrelevant to the fire control or emergency rescue. When there is a temporary demand of public service like landscaping, city sanitation for the municipal fire hydrants, the users’ institution has to sign the agreement with the water supply enterprise, and comply with the agreed time and place.
第十二條 市政消火栓的維護(hù)保養(yǎng)由供水企業(yè)實(shí)施，城市供水管理部門負(fù)責(zé)督促其履行職責(zé)。
單位消火栓和居民消火栓分別由所在單位或者物業(yè)服務(wù)企業(yè)負(fù)責(zé)維護(hù)保養(yǎng)。
Article 12 The maintenance of municipal fire hydrants are carried out by the water supply enterprise and the urban water supply administration department is responsible for supervising the performance of its duty.
The corresponding institutions and the property service companies are responsible for the maintenance of institutional and residential fire hydrants respectively.
第十三條 消火栓的維護(hù)保養(yǎng)單位應(yīng)當(dāng)遵守下列規(guī)定：
（二）確保消火栓完好有效，無(wú)部件缺損和漏水現(xiàn)象；發(fā)現(xiàn)消火栓丟失、損毀或者接到報(bào)修電話的，應(yīng)當(dāng)及時(shí)進(jìn)行維修、更換或者補(bǔ)裝；
（四）建立消火栓維護(hù)保養(yǎng)檔案，檔案內(nèi)容應(yīng)當(dāng)包括消火栓位置、數(shù)量、編號(hào)、規(guī)格及維護(hù)保養(yǎng)情況。
Article 13 Those who are responsible for the fire hydrant’s maintenance should comply with the following provisions:
(1) To equip the fire hydrants with full-time staff and establish and improve the inspection, maintenance and management system;
(2) To ensure the fire hydrants are intact and workable so that nothing is defected and there is no water leakage. Timely repair, maintenance, replacement or supplement should be carried on once there is a loss, defect or receiving a reporting call;
(3) To test the water two times a year, and remove the plug sewage;
(4) To establish the maintenance archives of fire hydrants maintenance, including the location, quantity, numbers, specifications, and the maintenance situations.
第十四條 公安機(jī)關(guān)消防機(jī)構(gòu)應(yīng)當(dāng)加強(qiáng)對(duì)消火栓的監(jiān)督管理。在實(shí)施監(jiān)督抽查中，發(fā)現(xiàn)消火栓存在問題需要維修的，應(yīng)當(dāng)及時(shí)通知維護(hù)保養(yǎng)單位進(jìn)行修復(fù)；發(fā)現(xiàn)市政消火栓設(shè)置不適應(yīng)實(shí)際需要的，應(yīng)當(dāng)及時(shí)報(bào)告當(dāng)?shù)厝嗣裾?/span>
Article 14 The fire control agency of the public security organization should strengthen the supervision and management of the fire hydrants. In the process of supervision and spot check, fire control agency should notify the responsible person or institution to repair if there is something wrong with fire hydrant and thus need repairing; the fire control agency should notify the local municipal government if the setting of municipal fire hydrants failed to adapt to the actual need.
第十五條 供水企業(yè)應(yīng)當(dāng)根據(jù)公安機(jī)關(guān)消防機(jī)構(gòu)制定的編號(hào)規(guī)則做好市政消火栓的編號(hào)、建檔等工作。按照美觀、統(tǒng)一、便利的原則，將消火栓安裝特色標(biāo)識(shí)，便于使用和維護(hù)。
市政消火栓信息數(shù)據(jù)庫(kù)應(yīng)當(dāng)納入數(shù)字化城市管理信息系統(tǒng)，實(shí)現(xiàn)信息資源共享。
Article 15 The water supply enterprise should carefully record the municipal fire hydrants like numberings and filings according to the numbering rules made by the fire control agency. The water supply enterprise should equip fire hydrants with characteristic identification on principles of aesthetics, unification and convenience, consequently, so they can be used and maintained more easily.
The municipal fire hydrant database should be included in the digital city management information system, realizing the sharing of information resources.
第十六條 因城市建設(shè)需要拆遷市政消火栓的，應(yīng)當(dāng)制定補(bǔ)建方案報(bào)公安機(jī)關(guān)消防機(jī)構(gòu)備案。
因施工影響消火栓使用的，施工單位應(yīng)當(dāng)事先告知當(dāng)?shù)毓矙C(jī)關(guān)消防機(jī)構(gòu)及供水企業(yè)，施工結(jié)束后應(yīng)當(dāng)恢復(fù)消火栓的使用。
Article 16 When the municipal fire hydrants have to be demolished because of the requirement of city construction, a supplementary construction plan has to be made immediately and reported to the fire control agency of public security organization for record.
When the municipal fire hydrants are affected by the construction, the contractor has to report it to the local fire control agency of public security organization and water supply enterprise. And fire hydrants must be recovered after the completion of the construction project.
第十七條 任何單位和個(gè)人都有保護(hù)消火栓的義務(wù)，發(fā)現(xiàn)消火栓損壞或者損壞消火栓行為應(yīng)當(dāng)及時(shí)報(bào)告城市供水管理部門或公安機(jī)關(guān)消防機(jī)構(gòu)。
Article 17 All institutions and individuals have the obligation to protect the fire hydrants. All the damages of the fire hydrants and actions trying to damage them should be reported to the urban water supply administration department or the fire control agency of public security organization.
第十八條 公安機(jī)關(guān)消防機(jī)構(gòu)在組織和指揮火災(zāi)現(xiàn)場(chǎng)撲救時(shí)，可以調(diào)動(dòng)供水企業(yè)協(xié)助滅火救援，保證消火栓水壓和不間斷供水。
Article 18 The fire control agency of public security organization can mobilize the water supply enterprise to assist fire fighting and rescue, on the premise of ensuring normal water pressure of fire hydrant are not interrupted water supply, when organizing the fire fighting.
第十九條 任何單位和個(gè)人不得有下列影響消火栓正常使用的行為：
（一）埋壓、圈占、遮擋消火栓；
（二）擅自拆除、停用、挪用或損壞消火栓；
（三）在消火栓
（四）其他影響消火栓正常使用的行為。
Article 19 Any institution and individual shall not have the following behaviours that may influence the normal use of the fire hydrant:
(1) To bury, occupy or cover a fire hydrant;
(2) To demolish, misappropriate, remove or damage the fire hydrants;
(3) To tack items, stall, park or construct facilities that hinder the fire engine’s water intake within a radius of 5 meters of fire hydrants.
(4) Other behaviours that influence the normal use of the fire hydrant
第二十條 違反本辦法第十一條規(guī)定，擅自從消火栓取水的，由公安機(jī)關(guān)消防機(jī)構(gòu)責(zé)令改正，對(duì)個(gè)人處警告或者100元以上500元以下罰款，對(duì)單位處以5000元以上20000元以下罰款。
違反本辦法第十一條規(guī)定，擅自從消火栓取水的，還應(yīng)當(dāng)向供水企業(yè)補(bǔ)交五倍以上十倍以下水費(fèi)。
Article 20 Those who get water from the fire hydrant without permission, violating Article 11 of these provisions, will be demanded a correction and fined by the fire control agency of public security organization. Individual will be warned and be imposed a fine of more than 100 CNY, less than 500 CNY. Institution will be imposed a fine of more than 5000, less than 20000 CNY.
Those who get water from the fire hydrant without permission, violating Article 11 of these provisions, will pay the water supply enterprise at the rate of more than 5 times, less than 10 times as much as the normal water fee.
第二十一條 消火栓的維護(hù)保養(yǎng)單位違反本辦法第十三條規(guī)定，有下列行為之一的，由公安機(jī)關(guān)消防機(jī)構(gòu)責(zé)令限期改正；逾期不改正的，處以1000元以上5000元以下罰款：
（一）未按照規(guī)定建立巡視、維護(hù)和管理制度，履行巡視、維護(hù)和管理職責(zé)的；
（二）接到報(bào)修電話或者相關(guān)部門的通知，未按規(guī)定時(shí)間對(duì)缺失、損毀的消火栓設(shè)施進(jìn)行維修、補(bǔ)裝的；
（三）未按照規(guī)定提供消火栓檔案資料的。
Article 20 Those institutions responsible for the maintenance of fire hydrants which violate Article 13 mentioned above and have the following behaviours, will be demanded a correction by the fire control agency of public security organization. If the same act is repeated but there will be not correction, responsible and the institutions will be imposed a fine of more than 1000 CNY, less than 5000 CNY.
(1) Failure to equip the fire hydrants with full-time staff and to establish and improve the inspection, maintenance and management system in accordance with the provisions;
(2) Failure to carry on timely repair, maintenance, replacement or supplement once receiving a reporting call or announcement from other relevant department within the specified time;
(3) Failure to provide the archive information of fire hydrant in accordance with the provision.
第二十二條 違反本辦法第十九條規(guī)定，影響消火栓正常使用的，由公安機(jī)關(guān)消防機(jī)構(gòu)責(zé)令改正，對(duì)個(gè)人處警告或者100元以上500元以下罰款，對(duì)單位處以5000元以上50000元以下罰款。
Article 22 Those individuals and institutions which violate Article 19 and influence the normal use of the fire hydrant will be demanded a correction and fined by the fire control agency of public security organization. Individual will be warned and be imposed a fine of more than 100 CNY, less than 500 CNY. Institution will be imposed a fine of more than 5000, less than 20000 CNY.
第二十三條 市、縣（市、區(qū)）人民政府有關(guān)部門或單位違反本辦法的，由人民政府或者監(jiān)察部門依照管理權(quán)限予以通報(bào)，責(zé)令限期改正，對(duì)部門或單位直接負(fù)責(zé)的主管人員和其他直接責(zé)任人員依法給予處分。
Article 23 Those relevant departments or institutions of municipality and counties (the city and the districts) people’s government which violate these provisions will be notified and demanded a correction within a time limit in accordance with their administrative rights. The person in charge of the department or other persons directly responsible shall be punished according to law.
第二十四條 已接入供水管網(wǎng)的鄉(xiāng)（鎮(zhèn)）、村莊，應(yīng)當(dāng)按照規(guī)劃配建消火栓，產(chǎn)權(quán)歸鄉(xiāng)（鎮(zhèn)）、村所有的，由鄉(xiāng)（鎮(zhèn)）、村負(fù)責(zé)建設(shè)和維護(hù)管理，未接入供水管網(wǎng)的，應(yīng)當(dāng)結(jié)合實(shí)際設(shè)置消防取水口，具體辦法由縣（市、區(qū)）人民政府制定。
Article 24 The townships (towns), or villages that have been included as a part of the water supply network should install fire hydrants according to the planning. The townships (towns) or villages are responsible for the maintenance of fire hydrants owned by the townships (towns) or villages. Others which are not included as a part of the water supply network should set the fire protection water intake based on the actual conditions, and the detailed plan will be made by the counties (the city and the districts) people’s government.
第二十五條 本辦法自2017年
Article 25 The measures will enter into force on February 1, 2017.
