The Measures of Handan Municipality on the Administrative Mediation which was adopted on the 2nd executive meeting of Handan Municipal People’s Government on April 19, 2017, is hereby promulgated and shall come into force on July 1, 2017.

第一章 總 則
Chapter 1 General Principles
第一條 為規(guī)范行政機(jī)關(guān)的行政調(diào)解,及時(shí)、有效化解爭議糾紛,促進(jìn)社會和諧穩(wěn)定,根據(jù)有關(guān)法律法規(guī)規(guī)定,結(jié)合本市實(shí)際情況,制定本辦法。
Article
第二條 本市各級行政機(jī)關(guān)和法律法規(guī)授權(quán)的組織(以下簡稱行政機(jī)關(guān))開展行政調(diào)解,適用本辦法。
Article 2 These Measures apply to the administrative mediation of the administrative organs at all levels and organizations authorized by rules and regulations (hereinafter referred to as “the administrative organs”) .
受委托的行政執(zhí)法機(jī)構(gòu),在委托機(jī)關(guān)的監(jiān)督指導(dǎo)下,按照本辦法的規(guī)定實(shí)施行政調(diào)解。
The authorized administrative law-enforcement agency should carry out administrative mediation in accordance with these Measures under the supervision and guidance of the authorizing organ.
第三條 市、縣(市、區(qū))政府應(yīng)當(dāng)加強(qiáng)對本行政區(qū)域內(nèi)行政調(diào)解工作的領(lǐng)導(dǎo),保障行政調(diào)解所必需的工作條件和經(jīng)費(fèi),健全行政調(diào)解與人民調(diào)解、司法調(diào)解的銜接機(jī)制,加強(qiáng)行政調(diào)解隊(duì)伍建設(shè)。
Article 3 The governments of Handan municipality and counties (the city and districts) should strengthen the leadership of administrative mediation within their administrative division, guarantee the necessary working conditions and expenses for administrative mediation, improve cohesion in the mediation mechanism by encouraging administrative mediation, people mediation and judicial mediation and reinforce the development and strength of the administrative mediation team.
市、縣(市、區(qū))政府法制機(jī)構(gòu)和部門法制機(jī)構(gòu)負(fù)責(zé)指導(dǎo)、協(xié)調(diào)本行政區(qū)域、本系統(tǒng)行政調(diào)解工作。
The departments of legislative affairs of
市、縣(市、區(qū))政府工作部門要保障開展行政調(diào)解工作必備的調(diào)解室、記錄設(shè)備、辦公經(jīng)費(fèi)等,加強(qiáng)對本領(lǐng)域、本系統(tǒng)行政調(diào)解工作業(yè)務(wù)指導(dǎo)和協(xié)調(diào)推進(jìn)。
The functional departments of
第四條 行政機(jī)關(guān)應(yīng)當(dāng)確定專門機(jī)構(gòu)統(tǒng)籌本機(jī)關(guān)的行政調(diào)解工作。
Article 4 The administrative organ shall appoint a specialized officer to be responsible for the administrative mediation work of their own organization.
行政機(jī)關(guān)可以根據(jù)工作需要聘請行政調(diào)解輔助人員,保證行政調(diào)解工作正常開展。
The administrative organ may employ support staff for administrative mediation to ensure the normal function of the administrative mediation work when and where necessary in the light of work requirements.
行政調(diào)解工作所需經(jīng)費(fèi)列入本單位預(yù)算。
The expenses for administrative mediation work shall be included in the budget of individual administrative organ.
第五條 行政機(jī)關(guān)開展行政調(diào)解,應(yīng)當(dāng)以事實(shí)為依據(jù),以法律為準(zhǔn)繩,不得損害國家利益、公共利益,以及公民、法人和其他組織的合法權(quán)益。
Article 5 The administrative organ shall be based on facts, take the law as the criterion to carry on the administrative mediation. The interests of the State and the public shall not be harmed, and the lawful rights and interests of a citizen, legal person or other organization must not be infringed upon during the mediation.
行政機(jī)關(guān)調(diào)解民事糾紛,應(yīng)當(dāng)保持客觀中立,不得偏袒、包庇一方當(dāng)事人。
When mediating civil disputes, the administrative organ shall remain objective and impartial and not show favoritism and/or shielding to any party concerned.
行政機(jī)關(guān)調(diào)解行政爭議,不得影響法定職責(zé)的行使,不得以行政調(diào)解代替行政執(zhí)法。
The administrative organ that mediates administrative disputes shall not affect the performance of administrative duties according to law, shall not replace administrative law enforcement with administrative mediation (shall not substitute administrative mediation for administrative law enforcement).
第六條 行政機(jī)關(guān)在行政調(diào)解中,發(fā)現(xiàn)糾紛有可能激化的,應(yīng)當(dāng)采取有針對性的預(yù)防措施;對有可能引起治安案件、刑事案件的糾紛,應(yīng)當(dāng)及時(shí)通知當(dāng)?shù)毓矙C(jī)關(guān)或者其他有關(guān)部門。
Article
第七條 當(dāng)事人在行政調(diào)解中應(yīng)當(dāng)遵守調(diào)解秩序,如實(shí)陳述爭議糾紛事實(shí),自覺履行達(dá)成的調(diào)解協(xié)議。
Article
行政機(jī)關(guān)在行政調(diào)解中不得拒絕當(dāng)事人提供證據(jù),不得拒絕當(dāng)事人終止調(diào)解的要求。
In the administrative mediation, the administrative organ may not refuse the parties concerned to provide evidence, and may not refuse upon request of the parties concerned a termination of the mediation.
第二章 民事糾紛調(diào)解
Chapter 2: Mediation of Civil Disputes
第八條 法律、法規(guī)、規(guī)章規(guī)定可以由行政機(jī)關(guān)調(diào)解的公民、法人和其他組織之間的下列民事糾紛,行政機(jī)關(guān)可以依法進(jìn)行調(diào)解:
Article 8 The following civil disputes between citizens, legal personality and other organizations may be mediated by the administrative organs in accordance with the rules and regulations:
(一)可以進(jìn)行治安調(diào)解的民間糾紛;
(1) Civil disputes that can be mediated by public security;
(二)交通事故損害賠償糾紛;
(2) Disputes of compensation arising from traffic accident;
(三)合同糾紛;
(3) Contract disputes;
(四)醫(yī)療事故賠償糾紛;
(4) Dispute over compensation for medical accidents;
(五)消費(fèi)者權(quán)益保護(hù)糾紛、產(chǎn)品質(zhì)量糾紛;
(5)Disputes regarding consumer protection and product quality;
(六)土地承包經(jīng)營糾紛;
(6)Disputes of land contractual management;
(七)侵犯商標(biāo)專用權(quán)、專利權(quán)等知識產(chǎn)權(quán)的賠償糾紛;
(7) Disputes over compensation for intellectual property rights like infringement of trademark exclusive right, patent right, etc.
(八)環(huán)境污染賠償糾紛;
(8) Disputes of compensation for environmental pollution
(九)電力糾紛、水事糾紛;
(9) Disputes regarding electricity and water issues;
(十)其他依法可以調(diào)解的民事糾紛。
(10) Other civil disputes that can be mediated by law.
第九條 前條規(guī)定的民事糾紛,當(dāng)事人或其代理人可以向法律、法規(guī)、規(guī)章規(guī)定的行政機(jī)關(guān)申請調(diào)解。
Article 9 The parties or agencies concerned in the civil disputes mentioned in the last article can apply for mediation to other administrative organs according to the rules and regulations.
申請調(diào)解民事糾紛應(yīng)當(dāng)符合下列條件:
In applying for mediation of civil disputes, the following conditions shall be met:
(一)與民事糾紛有直接利害關(guān)系;
(1) With direct interest relationship with the civil disputes;
(二)有明確具體的調(diào)解請求、事實(shí)和理由;
(2) With clear and specific mediation requests, facts and reasons;
(三)民事糾紛尚未被人民法院、仲裁機(jī)構(gòu)、人民調(diào)解組織或者其他行政機(jī)關(guān)受理或者處理。
(3) Civil disputes have not yet been accepted or dealt with by the people's courts, arbitration institutions, people's mediation organizations or other administrative organs.
當(dāng)事人申請調(diào)解民事糾紛應(yīng)當(dāng)說明基本情況、調(diào)解請求、事實(shí)和理由等。行政機(jī)關(guān)應(yīng)當(dāng)自當(dāng)事人申請之日起5個(gè)工作日內(nèi)征求對方當(dāng)事人意見,并決定是否受理。
Any party concerned shall explain the basic situation, the request for mediation, the facts and the reasons, etc. The administrative organ shall solicit the opinions of the other party concerned within 5 working days from the date of the application by one party, and decide whether to accept it or not.
最后一方當(dāng)事人同意調(diào)解之日,視為行政調(diào)解受理之日。
The date of the last party concerned agreeing mediation shall be deemed to be the day when the administrative mediation is accepted.
第十條 行政機(jī)關(guān)在履行行政管理職責(zé)過程中發(fā)現(xiàn)屬于行政調(diào)解范圍的民事糾紛,應(yīng)當(dāng)在征得雙方當(dāng)事人同意后啟動調(diào)解。
Article 10 When an administrative organ finds a civil dispute within the scope of administrative mediation in the course of performing its administrative duties, it shall start the mediation after obtaining the consent of both parties concerned.
第十一條 行政機(jī)關(guān)調(diào)解民事糾紛,由其具體承擔(dān)行政調(diào)解工作的機(jī)構(gòu)2名以上工作人員擔(dān)任行政調(diào)解員,經(jīng)雙方當(dāng)事人同意,也可以由1名工作人員擔(dān)任行政調(diào)解員。
Article 11 When the administrative organ mediates civil disputes, more than 2 staff members who are responsible for administrative mediation should work as administrative officers. 1 staff for the administrative officer is also applicable by the consent of both parties concerned.
第十二條 行政機(jī)關(guān)決定調(diào)解的,應(yīng)當(dāng)書面告知當(dāng)事人調(diào)解的時(shí)間、地點(diǎn)、調(diào)解人員等事項(xiàng)。決定不予受理的,應(yīng)當(dāng)書面告知當(dāng)事人理由。
Article 12 When the administrative organ decides to mediate, it shall notify the parties with written relevant reports, for instance, time and place for mediation etc. For the cases the administrative organ decides not to accept, any party concerned shall be informed in writing.
第十三條 行政調(diào)解人員有下列情形之一的,應(yīng)當(dāng)主動回避;不主動回避的,當(dāng)事人有權(quán)申請其回避:
Article 13 If an administrative conciliation officer is under any of the following circumstances, the officer shall take the initiative to evade (active avoidance). If the officer does not take the initiative to evade, any party concerned has the right to apply for the withdrawal of an officer.
(一)是民事糾紛當(dāng)事人或者與當(dāng)事人有近親屬關(guān)系的;
(1) The officer is exactly one party concerned or has kinship with one party concerned.
(二)與民事糾紛有利害關(guān)系的;
(2) The officer has relations of interests with the civil dispute
(三)與民事糾紛當(dāng)事人有其他關(guān)系,可能影響公正調(diào)解的。
(3) The officer has other types of relationships, which may lead to the unfair mediation.
當(dāng)事人申請回避的,行政機(jī)關(guān)負(fù)責(zé)人或其授權(quán)的人員應(yīng)當(dāng)及時(shí)作出是否回避的決定。決定回避的,應(yīng)當(dāng)及時(shí)更換行政調(diào)解人員;不需要回避的,告知當(dāng)事人理由。
When any party concerned applies for the officer’s withdrawal, the person responsible for administrative organ or the person authorized shall make a decision whether or not to withdraw in a timely manner. If it is decided to evade, the responsible person or organization should change the officer within prescribed time frame. If it is decided not to evade, any party concerned should be informed of the reasons.
第十四條 當(dāng)事人之外的公民、法人或者其他組織與民事糾紛有利害關(guān)系的,可以申請參加調(diào)解或者由行政機(jī)關(guān)通知其參加調(diào)解。
Article 14 Any citizens, legal personality or other organizations other than any party concerned directly, who has an interest relationship in this civil dispute, may apply to participate in the mediation process or may be notified by the administrative organ to participate in the mediation.
行政機(jī)關(guān)調(diào)解民事糾紛,根據(jù)需要,可以邀請有關(guān)單位、專業(yè)人員或者其他有關(guān)人員參與調(diào)解。
If needed, the administrative organ may invite relevant organizations, professionals or other relevant personnel to participate in the mediation in the process of mediating civil disputes.
第十五條 行政機(jī)關(guān)調(diào)解民事糾紛,當(dāng)事人應(yīng)當(dāng)如實(shí)提供證據(jù),并對所提供的證據(jù)承擔(dān)責(zé)任。
Article 15 The parties concerned shall provide true evidence and bear the responsibility for the evidence provided when the administrative organ is dealing with and mediating the civil disputes.
第十六條 行政機(jī)關(guān)調(diào)解民事糾紛,應(yīng)當(dāng)聽取當(dāng)事人的陳述,向當(dāng)事人講解有關(guān)法律、法規(guī)、規(guī)章和政策,在分清事理、明辨法理的基礎(chǔ)上,引導(dǎo)當(dāng)事人自愿達(dá)成調(diào)解協(xié)議。
Article 16 The administrative organ should listen to the statements of the parties concerned, should explain the relevant laws and regulations, rules and policies to the parties concerned and should guide the parties concerned voluntarily reach the mediation settlement agreements on a reasonable and legal basis in the process of mediating the civil disputes.
第十七條 行政機(jī)關(guān)調(diào)解民事糾紛,應(yīng)當(dāng)自行政機(jī)關(guān)受理之日起30日內(nèi)結(jié)束;情況復(fù)雜或者有其他特殊情形的,經(jīng)當(dāng)事人同意,可以適當(dāng)延長,延長期限不得超過30日。法律、法規(guī)、規(guī)章另有規(guī)定的,從其規(guī)定。
Article 17 For mediation of civil disputes, the administrative organ shall finish within 30 days from the date of acceptance by the administrative organ; If the situation is complicated or in other special circumstances, it may be appropriately extended by the consent of the parties, and the extension shall not exceed 30 days. Where national laws, regulations or rules provide otherwise, such provisions shall prevail.
第十八條 經(jīng)調(diào)解達(dá)成協(xié)議的,行政機(jī)關(guān)應(yīng)當(dāng)制作調(diào)解協(xié)議書,調(diào)解協(xié)議書應(yīng)當(dāng)由當(dāng)事人簽名、蓋章,并加蓋行政機(jī)關(guān)印章確認(rèn),當(dāng)事人各執(zhí)一份,行政機(jī)關(guān)留存一份;當(dāng)事人認(rèn)為無需制作調(diào)解協(xié)議書的,可以采取口頭協(xié)議方式,行政調(diào)解人員應(yīng)當(dāng)記錄協(xié)議內(nèi)容,雙方當(dāng)事人簽名、蓋章。
Article 18 When disputes are settled by mediation, the administrative organ shall make a mediation agreement, which need to be signed and stamped by all the parties concerned, and to be confirmed by the seal of administrative organ. Each party concerned shall hold one copy, and the administrative organ shall keep one copy. When the parties concerned believe that the mediation agreement is not necessary, the oral mediation agreement may be adopted. In this case, administrative mediation personnel shall record the contents of the oral agreement, and the parties concerned shall sign and seal it.
調(diào)解協(xié)議書自當(dāng)事人簽名、蓋章之日起生效,口頭協(xié)議自當(dāng)事人達(dá)成協(xié)議之日起生效。
The mediation agreement shall come into force on the date of agreement being signed and sealed of the parties. The oral agreement shall come into force upon the date of the agreement being reached by the parties.
第十九條 經(jīng)調(diào)解無法達(dá)成協(xié)議或者當(dāng)事人要求終止調(diào)解的,行政機(jī)關(guān)應(yīng)當(dāng)終止調(diào)解,出具終止調(diào)解通知書,并告知當(dāng)事人可以通過訴訟、仲裁等途徑解決民事糾紛。
Article 19 The administrative organ shall stop the mediation and issue a notice of termination of mediation when it is unable to reach an agreement through mediation or the parties ask to terminate the mediation. Meanwhile, they shall inform the parties, through litigation, arbitration and other ways to resolve civil disputes.
行政機(jī)關(guān)認(rèn)為當(dāng)事人雙方意愿差距較大、不具備達(dá)成協(xié)議條件的,可以終止調(diào)解,出具終止調(diào)解通知書。
The administrative organ may terminate the mediation and issue a notice of termination of the mediation, if the administrative organ considers that the parties have a larger gap of intent, and there is no condition for reaching the agreement.
第二十條 調(diào)解協(xié)議書應(yīng)當(dāng)載明下列事項(xiàng):
Article 20 The mediation agreement shall set forth the following items:
(一)當(dāng)事人的基本情況;
(1) The basic circumstances of the parties concerned;
(二)調(diào)解請求;
(2) Mediation request;
(三)調(diào)解協(xié)議內(nèi)容;
(3) The content of the mediation agreement;
(四) 其他需要載明的事項(xiàng)。
(4) Other matters that need to be stated.
第二十一條 行政機(jī)關(guān)對民事糾紛進(jìn)行調(diào)處后達(dá)成的有民事權(quán)利義務(wù)內(nèi)容的調(diào)解協(xié)議或者作出的其他不屬于可訴具體行政行為的處理,經(jīng)雙方當(dāng)事人簽字或者蓋章后,具有民事合同性質(zhì),法律另有規(guī)定的除外。
Article 21 The mediation settlement agreements with civil rights and obligations after mediation of civil disputes by administrative organs, and/or other administrative handling decisions that does not belong to actionable administrative acts, has the nature of civil contract which is being signed or stamped by both parties concerned. Except otherwise stated by law.
第二十二條 對調(diào)解協(xié)議,經(jīng)行政機(jī)關(guān)蓋章后,當(dāng)事人可以申請有管轄權(quán)的人民法院確認(rèn)其效力。當(dāng)事人請求履行調(diào)解協(xié)議、請求變更、撤銷調(diào)解協(xié)議或者請求確認(rèn)調(diào)解協(xié)議無效的,可以向人民法院提起訴訟。
Article 22 After the mediation settlement agreements have been sealed by the administrative organ, any party concerned may apply to the people's court with jurisdiction to confirm its validity. When the concerned parties failed to request the execution, alteration, cancellation of the mediation settlement agreements, and/or failed to request that the mediation settlement agreements are invalid, any party concerned may bring a lawsuit to the people's court.
具有給付內(nèi)容的調(diào)解協(xié)議,當(dāng)事人可以按照《中華人民共和國公證法》的規(guī)定申請公證機(jī)關(guān)依法賦予強(qiáng)制執(zhí)行效力。債務(wù)人不履行或者不適當(dāng)履行具有強(qiáng)制執(zhí)行效力的公證文書的,債權(quán)人可以依法向有管轄權(quán)的人民法院申請執(zhí)行。
For the mediation settlement agreements with the content of payment, any party concerned may apply to the notary organization for its enforcement effect in accordance with the provisions of the Notarization Law of the People's Republic of China. If the debtor fails to perform or improperly performs the notary documents with compulsory enforcement, the creditor may apply to the people's court for its enforcement with jurisdiction in accordance with the law.
第三章 行政爭議調(diào)解
Chapter 3 Mediation of Administrative Disputes
第二十三條 在行政復(fù)議和行政訴訟中,公民、法人或者其他組織與行政機(jī)關(guān)之間的下列行政爭議可以進(jìn)行行政調(diào)解:
Article
(一)涉及行政賠償?shù)模?/span>
(1) Involving administrative damages;
(二)涉及行政補(bǔ)償?shù)模?/span>
(2) Involving administrative compensation;
(三)涉及行政機(jī)關(guān)行使自由裁量權(quán)的。
(3) Involving the discretionary power’s execution of an administrative organ.
除前款規(guī)定外,行政機(jī)關(guān)與當(dāng)事人還可以就行政確權(quán)、行政征收征用、行政強(qiáng)制、行政強(qiáng)制執(zhí)行、行政告知以及行政不作為等引發(fā)的行政爭議達(dá)成和解。
In addition to the preceding provisions, the administrative organ and the party concerned still can make an agreement on the administrative disputes regarding adjudication of administrative rights, administrative expropriation, administrative compulsion, administrative compulsory execution, administrative notification and administrative omission etc.
第二十四條 因前條第一款規(guī)定啟動的行政調(diào)解,應(yīng)當(dāng)在行政復(fù)議機(jī)關(guān)(含行政復(fù)議機(jī)構(gòu))或人民法院的指導(dǎo)下進(jìn)行。
Article 24 The administrative mediation started by Article 23 paragraph 1 should be carried out under the guidance of the administrative review organization (including administrative review organization) or the people's court.
因前條第二款規(guī)定啟動的行政和解,作出原行政行為的行政機(jī)關(guān)可與當(dāng)事人就行政爭議達(dá)成和解協(xié)議,依法維持、改變或撤銷原具體行政行為。
As for the administrative mediation started by paragraph 2 of Article 23, the administrative organ that has made the original administrative act may reach a settlement agreement on administrative disputes with the party concerned, which may include maintaining, altering or cancelling the original specific administrative act in accordance with the law.
在行政復(fù)議或行政訴訟中,行政機(jī)關(guān)與當(dāng)事人自行達(dá)成和解協(xié)議,撤銷原行政行為,重新作出行政行為的,應(yīng)當(dāng)告知行政復(fù)議機(jī)關(guān)(含行政復(fù)議機(jī)構(gòu))或者人民法院。In the administrative reviews or administrative litigations, when administrative organs and the parties reached a settlement agreement to cancel the original administrative behavior, and to make new administrative act, they shall inform administrative organs (including administrative review institutions) or the people's court.
第二十五條 行政機(jī)關(guān)調(diào)解行政爭議,可以確定由原行政行為的承辦機(jī)構(gòu)承擔(dān)行政調(diào)解工作,也可以確定由其他機(jī)構(gòu)承擔(dān)行政調(diào)解工作,但原行政行為的承辦人不得擔(dān)任調(diào)解人。
Article 25 When administrative organ mediates administrative disputes, it can be carried out by the administrative agency of the original administrative act or other agencies. However, the one who carried out the original administrative act shall not act as a mediator.
第二十六條 當(dāng)事人之外的公民、法人或者其他組織與行政爭議有利害關(guān)系的,行政機(jī)關(guān)應(yīng)當(dāng)通知其參加調(diào)解。
Article 26 If the other citizens, legal personality or other organizations apart from the parties directly concerned have relationship of interest with the administrative disputes, the administrative organ shall notify them to participate in the mediation.
第二十七條 調(diào)解人員調(diào)解行政爭議,應(yīng)當(dāng)聽取當(dāng)事人的陳述,向當(dāng)事人講解相關(guān)法律、法規(guī)、規(guī)章和政策,告知當(dāng)事人執(zhí)法依據(jù)、理由和相關(guān)考慮因素,答復(fù)當(dāng)事人的疑問。
Article 27 Mediator shall listen to the statements of the parties concerned, and shall explain the relevant laws, regulations, rules and policies to the them, inform the parties concerned of the basis of the law enforcement, the reasons and the relevant considerations, and answer the question of parties concerned, when mediating the administrative disputes.
第二十八條 行政機(jī)關(guān)調(diào)解行政爭議,應(yīng)當(dāng)自當(dāng)事人同意調(diào)解之日起30日內(nèi)結(jié)束,情況復(fù)雜或者有其他特殊情形的,經(jīng)當(dāng)事人同意,可以適當(dāng)延長,延長期限不得超過30日。法律、法規(guī)、規(guī)章另有規(guī)定的,從其規(guī)定。
Article 28 The administrative organs shall complete the mediation within 30 days from the date the parties agreed to mediate. If the situation is complicated or in other special circumstances, it may be appropriately extended by the consent of the parties concerned, and the extension shall not exceed 30 days. Where laws, regulations or rules provide otherwise, such provisions shall prevail.
行政機(jī)關(guān)與當(dāng)事人無法達(dá)成協(xié)議或者當(dāng)事人要求終止調(diào)解的,行政機(jī)關(guān)應(yīng)當(dāng)終止調(diào)解。
When the administrative organ and the party concerned fail to reach an agreement or the party concerned require termination of the mediation, the administrative organ shall terminate the mediation.
第二十九條 對依法可以調(diào)解的行政爭議,行政復(fù)議機(jī)構(gòu)可以進(jìn)行案前調(diào)解,也可以進(jìn)行案中調(diào)解。申請人既可以書面形式提出調(diào)解申請,也可以口頭提出調(diào)解申請。以口頭提出調(diào)解申請的,行政復(fù)議機(jī)構(gòu)應(yīng)當(dāng)制作筆錄。
Article 29 For administrative disputes which may be mediated by law, the administrative review organization may carry out mediation before or during the case. The applicant may either file a written application or submit an oral application for mediation. When an application for mediation is submitted orally, the administrative review organization shall record it in writing.
經(jīng)案前調(diào)解化解行政爭議的,申請人取回行政復(fù)議申請材料,并在行政復(fù)議申請材料取回證明文書上簽字;經(jīng)調(diào)解未化解行政爭議的,行政復(fù)議機(jī)構(gòu)應(yīng)當(dāng)轉(zhuǎn)入立案審查程序。
If the disputes are resolved by the mediation before the case, the applicant shall withdraw the application materials for the administrative review and signed on the certifying documents of withdrawing. If administrative disputes fail to be settled down in the mediation, the administrative review organ shall take it as a formal case-filing and review procedures.
行政復(fù)議機(jī)構(gòu)組織案中調(diào)解的,調(diào)解期間中止行政復(fù)議案件審查。
If the administrative organ mediates during the case, the administrative review case should be suspended during mediation.
第三十條 經(jīng)行政復(fù)議機(jī)構(gòu)調(diào)解達(dá)成協(xié)議的,行政復(fù)議機(jī)關(guān)應(yīng)當(dāng)制作行政復(fù)議調(diào)解書。行政復(fù)議調(diào)解書應(yīng)載明下列事項(xiàng):
Article 30 If an agreement is reached through mediation by the administrative review organization, the administrative review organization shall make a mediation document of administrative review.
(一)當(dāng)事人基本情況;
(1) Basic information of the parties concerned.
(二)行政復(fù)議請求、事實(shí)和理由;
(2) The requests, facts and reasons for the administrative review.
(三)調(diào)解協(xié)議的內(nèi)容、履行方式和期限;
(3) The content, means and deadline for the mediation settlement agreements.
(四)違反調(diào)解協(xié)議的法律責(zé)任;
(4) Legal liability for breach of the mediation settlement agreements ;
(五)其他相關(guān)事項(xiàng)。
(5) Other relevant issues.
當(dāng)事人認(rèn)為不需要制作調(diào)解書的,由申請人撤回行政復(fù)議申請,行政復(fù)議終止。
If the party concerned considers it unnecessary to make a mediation statement, the applicant shall withdraw the application for administrative review and terminate the administrative review.
第三十一條 行政機(jī)關(guān)與當(dāng)事人達(dá)成的調(diào)解協(xié)議或者依法作出的其他處理具有法律效力。對行政爭議達(dá)成的調(diào)解協(xié)議,行政機(jī)關(guān)已履行完畢,當(dāng)事人反悔,申請行政復(fù)議的,行政復(fù)議機(jī)關(guān)應(yīng)當(dāng)以誠信原則,把調(diào)解協(xié)議載明的內(nèi)容作為行政復(fù)議案件審理的重要事實(shí)根據(jù)。
Article 31 The mediation settlement agreements and other administrative handling decisions by the administrative organs according to law shall be legally effective. In case of the mediation settlement agreement has been already fulfilled entirely by the administrative organ, and the concerned party pulls back his/her complain and applies for an administrative review, the administrative review organ shall regard the contents of the mediation settlement agreements as an important reference for a trial of the administrative review case in accordance with the principle of good faith.
第四章 指導(dǎo)和監(jiān)督
Chapter 4 Supervision and Guidance
第三十二條 市、縣(市、區(qū))政府法制機(jī)構(gòu)應(yīng)當(dāng)加強(qiáng)對本行政區(qū)域內(nèi)行政調(diào)解工作的指導(dǎo),建立健全行政調(diào)解工作程序和規(guī)范,完善相關(guān)配套制度;定期組織對行政調(diào)解工作人員進(jìn)行業(yè)務(wù)培訓(xùn),提高行政調(diào)解工作人員的專業(yè)素質(zhì)。
Article 32 Municipality and counties (the city and districts) municipal legal organization should improve guidance of the administrative mediation work within their administrative division, perfect the administrative mediation procedures and norms, and improve the relevant supporting system. In addition, business training for administrative mediation staff should be organized regularly to improve their professionalism.
第三十三條 行政機(jī)關(guān)應(yīng)當(dāng)建立行政調(diào)解工作檔案,將記載調(diào)解申請、受理、過程、協(xié)議等內(nèi)容的相關(guān)材料立卷歸檔。
Article 33 Administrative organs shall establish administrative mediation work files, and place the relevant documents, for instance, mediation application and registration documents, mediation records and the mediation settlement agreements on file.
行政機(jī)關(guān)應(yīng)當(dāng)將重大行政調(diào)解案件報(bào)送同級政府法制機(jī)構(gòu)備案。
The administrative organ shall submit the cases of major administrative mediation to the legal institution of the same level for the record.
第三十四條 行政機(jī)關(guān)及其工作人員在行政調(diào)解過程中存在不履行、違法履行、不當(dāng)履行行政調(diào)解職責(zé)行為的,按照國家、省和本市有關(guān)規(guī)定對直接負(fù)責(zé)的主管人員和其他直接責(zé)任人員給予行政問責(zé)或行政處分。
Article 34 If administrative organs and their staff have no performance, illegal performance, or improper performance of their administrative mediation duties, administrative accountability or administrative sanction shall be given to the person directly in charge and other persons directly responsible in accordance with the relevant provisions of the state, the province and the municipality.
第三十五條 當(dāng)事人以行政機(jī)關(guān)出具的不予受理通知書、終止調(diào)解通知書、行政調(diào)解協(xié)議書等行政調(diào)解文書,或者以行政機(jī)關(guān)及其工作人員在行政調(diào)解中濫用職權(quán)或不作為申請行政復(fù)議的,行政復(fù)議機(jī)關(guān)不予受理,法律、法規(guī)、規(guī)章另有規(guī)定的除外。
Article 35 If the party concerned applies for the administrative review with the notice of non-acceptance, termination of mediation notice, administrative mediation settlement agreements and other administrative mediation documents, or with the abuse of authority and duty dereliction of administrative organs and their staff, the administrative review organization shall not accept it, except as otherwise provided for by laws, rules and regulations.
第五章 附 則
Chapter 5 Supplementary Articles
第三十六條 本辦法所稱行政調(diào)解,是指行政機(jī)關(guān)(包括法律法規(guī)授權(quán)組織和受委托執(zhí)法的組織)在日常行政管理和行政執(zhí)法過程中,對與本機(jī)關(guān)行使行政職權(quán)有關(guān)的各類爭議糾紛,以法律、法規(guī)、規(guī)章及政策為依據(jù),以當(dāng)事人自愿為原則,通過說服和疏導(dǎo),達(dá)成調(diào)解協(xié)議,快速解決爭議糾紛的活動。
Article 36 The administrative mediation in the provision, refers to the administrative organs (including laws and regulations, authorized organizations and entrusted law enforcement organizations) resolve the disputes with respect to all kinds of disputes arising from the execution of administrative powers of this organization in a quick manner, by persuasion and reaching the mediation settlement agreements, on the basis of laws, regulations, rules and policies, on the principle of voluntariness of the parties, in the process of daily administrative management and administrative law enforcement.
第三十七條 本辦法所稱的當(dāng)事人包括民事糾紛的雙方當(dāng)事人、行政爭議的行政相對人、與行政行為有利害關(guān)系的第三人。
Article 37 The parties concerned in this provision include the parties in the civil disputes, administrative counterparts in administrative disputes and the third parties who have an interest in the administrative act.

Article 38 These Measures shall come into force as of July 1, 2017.
